A Butler man was sentenced to the county Intermediate Punishment program in Butler County Court on Thursday, after being charged with driving under the influence with an infant passenger.

Nicklas J. Whallin, 24, was sentenced to six months in the program, with seven days on house arrest with electronic monitoring, by Judge William Shaffer.

He was also ordered to pay court costs and $700 in fines, complete 60 hours of community service, complete an Alcohol Highway Safety School, complete a drug and alcohol evaluation, attend a Victim Impact Panel and complete the county litter pickup program.

Whallin previously pleaded guilty to misdemeanor DUI high rate and summary driving on a suspended license on Dec. 15.

He was also initially charged with misdemeanor DUI, endangering the welfare of a child and summary disregarding traffic lanes after an incident on July 12, 2016.

The endangering charge was later withdrawn at the magisterial district court level, and the remaining charges were dismissed as part of the plea.

Jackson Township police filed the charges after Whallin was pulled over for driving at an unusually slow speed on Route 528 and then suddenly speeding up.

Whallin had a female passenger and an infant in the back seat of the vehicle and police could smell alcoholic odors coming from the vehicle, reports state. The infant was reported to be the female passenger's son.

Police said he was also found to have a suspended license, and told police he “probably had a six pack” of beer, documents state.

Blood tests showed Whallin had a blood-alcohol content of 0.108 percent.
