Thursday — A Butler couple is accused of failing to return $400 that a woman had given them last month as a kind of collateral payment for an apartment she later decided not to rent.Randolph D. Dahl Jr., 34, and Jamie L. Dahl, 33, the owners of the apartment, are both charged with theft by failure to make required disposition of funds and conspiracy. The alleged victim, Nancy Hinchberger, told police that on May 24 she met with Jamie Dahl to discuss renting the defendant's apartment on West Cunningham Street. At the meeting, Dahl agreed to hold the apartment for Hinchberger until the would-be tenant got the needed utility services.Hinchberger, in exchange, gave Dahl $400 that would be returned upon her renting the apartment, according to court documents. Police said the deal was spelled out in a note that Dahl signed using her husband's name. But on May 25, Hinchberger notified Dahl that she was unable to get the utilities in her name because of past debt problems, police said.Dahl told Hinchberger that she would return the $400, which had been deposited in the bank. But later that day Dahl told the alleged victim that “her (attorney) told her she didn't have to return the money.”Police on May 28 spoke by telephone with Randolph Dahl, who advised them he and his wife were keeping the money.
