Case dismissed against man accused in attack
BUTLER TWP — Felony and other charges have been dropped in the case of a township man accused of attacking a woman in a motel.
District Judge Kevin O’Donnell dismissed the case against 54-year-old David J. Perri after the alleged victim failed to show up for Perri’s preliminary hearing Thursday morning.
Butler Township police apparently have been unable to contact Perri’s accuser, Erika L. Celestin, on the phone or her last known address in Penn Township.
“I tried calling her,” said Patrolman Alan Mores, “but her phone’s been disconnected.”
Police arrested Perri after officers were called about 1 a.m. Dec. 8 to the Comfort Inn on Route 8 south for a report of a man and woman fighting in the lobby. But by the time officers arrived, the suspect was gone.
Celestin, who was soaking wet, told police that she and Perri had quarreled and when she tried to leave he threw her into the hot tub and held her head under water.
She eventually was able to get away and run to the front desk for help.
Perri was arrested Dec. 9 on charges of aggravated assault, reckless endangerment, possession of drug paraphernalia and harassment. He was placed in the Butler County Prison but released that same day after posting $5,000 bail.
In dismissing all charges, O’Donnell noted that prosecutors could still refile the case later.
Meanwhile, Perri on Thursday waived to court charges in an unrelated felony case.
Township police allege he was impaired by marijuana and prescription drugs Oct. 10 when his car rear-ended another vehicle on Route 422 near Route 8, court documents said.
The wreck forced the other car into the back of a third car that Leahanna McCloskey was driving. Police said Perri’s vehicle barrel rolled and ended on top of McCloskey’s car.
She was treated at Allegheny General Hospital in Pittsburgh for a seriously injured spine.
Toxicology reports later showed Perri had marijuana and anti-anxiety medications in his system, documents said.
He is charged with aggravated assault by vehicle while driving under the influence of drugs, a felony, and misdemeanor charges of drugged driving.
Perri’s attorney, Eric Levin, declined to comment on the two cases.
