Man sentenced to state prison for drug case
A man who dove out a second-story window while trying to escape police and was later charged with drug trafficking was sentenced to state prison on Dec. 7.
Bryant C. Rose, 41, was sentenced to two and a half years to 87 months in a state correctional facility by Judge Timothy McCune. He was given credit for time served of 748 days and was also ordered to pay court costs.
Rose pleaded guilty on Dec. 7 to felony possession with intent to deliver a controlled substance and conspiracy to commit possession with intent.
He was initially charged with four felony counts of possession with intent, one count of conspiracy, four misdemeanor counts of possession of a controlled substance and one count of resisting arrest after an incident at a West Diamond Street apartment on Nov. 18, 2015.
The remaining charges were dismissed as part of the plea.
The charges stem from a joint investigation by Butler City Police, the county district attorney's drug task force and agents of the state attorney general's Bureau of Narcotics Investigation into drug distribution at the apartment.
During the execution of a search warrant police said Rose dove out of a second-story window while trying to escape. Police said that Rose was subdued by a police dog after jumping from the window.
He was in possession of 796 stamp bags of heroin, with a street value of $7,960, about five grams of crack cocaine and several varieties of prescription drugs packaged for sale, and more than $1,300 in cash, police said.
A search of the apartment turned up scales and other drug paraphernalia, as well as six bags of marijuana in a backpack that police said belongs to Rose.
Also arrested in the raid were Shawn L. Nelson, 39, and Jennifer A. Young, 34, both of 319 W. Diamond St., Apt. 3.
Police believe the pair were allowing Rose to deal drugs out of the apartment. They both were charged with one count each of possession with intent to deliver, criminal conspiracy, and possession of drug paraphernalia.
Nelson pleaded guilty to the paraphernalia charge and was sentenced to 12 months time served. Young pleaded guilty to an amended summary disorderly conduct charge.
Rose is also facing extradition to Jefferson County, Ohio, on a warrant for felony drug trafficking charges after being indicted in Ohio in the fall of 2015.
