BUFFALO TWP — A not-so-gifted cat burglar who got stuck on the roof of a commercial building that police say he was trying to break into is due back in court next month.

Timothy L. Livengood, 28, of Buffalo Township faces formal arraignment Feb. 13 on attempted burglary and other charges.

Buffalo Township Police said Livengood stayed all night on the roof of the building on the 700 block of Ekastown Road that houses the Colonial Clinic, Colonial Pharmacy and K&R Pizza after a failed break-in try.

His plan went awry soon after 9 p.m. Dec. 20 when, armed with a pry bar, he climbed up to the top of the building. Livengood admitted, according to court documents, that he was trying to “gain access to the pharmacy to take drugs.”

But he could not get in — or down, apparently.

He told investigators that when daylight came he hid behind the air conditioning unit “in hopes he would not be seen.”

The building's owner arriving for work Dec. 21 and noticed the flue stack had been removed and shingles were ripped up on the roof. She called a repairman, who subsequently discovered Livengood laying — and stuck — on the roof.

Two officers helped rescue him before arresting him.

Later that day, it was discovered that someone had tried to break into K & R Pizza at the same building. Police said it appeared a pry bar was used in a failed attempt to force open the back door.

Livengood also would admit to that crime, too, documents said.

Livengood on Jan. 3 waived his preliminary hearing in the case filed at the office of District Judge Sue Haggerty in Saxonburg.

He is charged with two felony counts each of attempted burglary and attempted trespass. He also is charged with possessing an instrument of crime, two counts of criminal mischief, and loitering and prowling at night — all misdemeanors.

Livengood, who already has six prior burglary convictions, is being held in the Butler County Prison on $10,000 bail and on a probation detainer.
