After hearing from a victim who was unhappy with the result of a case against a Butler man charged with causing the crash that severely injured her, a Butler County judge rejected the man's plea agreement during sentencing proceedings Thursday.

Judge William Shaffer rejected the plea agreement entered by Domenic M. DeAngelo, 21, who previously pleaded guilty to misdemeanor simple assault and recklessly endangering another person, as well as summary failure to stop and give information or render aid on Jan. 8.

The decision came after the reading of a victim's impact statement by a member of the county district attorney's Victim Services Program.

The victim, Heather Brinker, stood by while the statement was read to the court, which said she “almost lost her life” because of this incident and DeAngelo's life “has not changed one bit, but my life has changed forever.”

“I didn't cause this.” the statement said. “I don't feel this is right, that this is being brushed off.”

Shaffer said, “I am not inclined to accept a plea agreement in a case where the victim is not satisfied with the results.”

The plea was rejected and withdrawn, and the case will be scheduled for further court proceedings.

DeAngelo apologized during the proceeding, calling the incident “very unfortunate.”

He was set to be sentenced to two years of probation, fines, restitution and court costs, per the plea agreement.

State police initially charged DeAngelo with felony aggravated assault by vehicle and several summary traffic violations after an incident on Route 8 in Center Township on Sept. 27, 2015.

The assault and endangerment charges were later added.

The charges stem from an incident where police said DeAngelo purposely ran another vehicle off the road, which was being driven by Brinker, 22, of Slippery Rock.

Police said Brinker had attempted to pass DeAngelo just north of Mercer Road around 4:15 a.m. Sept. 27, 2015, according to court documents.

Brinker, who was not wearing a seat belt, was thrown from her car after it hit an embankment and rolled over. She was flown by medical helicopter from the scene to UPMC Presbyterian hospital, where she underwent several surgeries for her injuries, police said.

Police said witnesses reported that DeAngelo chased Brinker's car after she left the Clearview Mall parking lot that morning, before attempting to hit her vehicle which prompted her to pull off into a parking lot.

Brinker told police that when she re-entered the road, DeAngelo was in front of her, continuing to hit his brakes trying to force her to stop, according to documents.

When she tried to pass him, DeAngelo drove into her lane and forced her car off the road before he drove off, documents said.

During an interview with police the next day, DeAngelo said Brinker was trying to pass him when he “drifted into the opposite lane” and jammed on his brakes, before driving off.
