Penn man says he's changed since wreck
A Penn Township man said he's sworn off alcohol since causing a collision that hurt a pregnant woman and killed a Chihuahua two years ago.
"I'm offering my heartfelt apology," Michael Colton, 59, said Thursday in Butler County Court. "I admit that I have made a horrible mistake."
Colton pleaded guilty to several charges, including aggravated assault while driving under the influence, simple assault and drunken driving.
This case was prosecuted by a deputy from the state Attorney General's Office, who offered no punishment recommendation in exchange for the plea.
Butler County Judge William Shaffer fashioned Colton's sentence, which includes 5 years under court supervision: The first 36 months in the county's Intermediate Punishment Program, followed by 24 months of probation.
Colton, who will spend the first six months of supervision on house arrest with electronic monitoring, also must pay more than $2,000 in fines, log-in 100 hours of community service and pay $540 in restitution to one of the victims.
Colton's defense attorney, Mike Pawk of Butler, told the judge that his client is "very remorseful," and even before sentencing paid the other victims more than $12,000 in restitution.
Additionally, Colton said he settled civil litigation in relation to the crash. He already has completed a highway safety program, sought counseling and has the support of friends and family, who wrote the judge letters that were not read in the court room.
The victims did not attend the hearing.
"I prayed for their recovery," Colton told the judge.
According to court records, the incident occurred in Cranberry Township Oct. 9, 2007.
Colton, who was reportedly intoxicated, was driving a pickup truck on Franklin Road when he sideswiped an oncoming truck operated by Brenda Swanson of Cranberry Township, according to court records.
Colton continued to drive for a quarter mile before his truck again crossed the centerline and collided with a car driven by Alyssa Carter, then 25, of Cranberry Township.
Carter, who was pregnant; a passenger in Carter's car, Christina Martin of Cranberry Township; and Colton all were injured. A Chihuahua in a purse-type carrier in Carter's car was killed, according to court records.
Court officials said Carter's baby has since been born safely.
