Butler man sentenced in city gunshot incident
A man accused of firing a gun toward a man in Butler in September was given a prison sentence Tuesday after pleading guilty to an aggravated assault charge in Butler County Common Pleas Court.
Dustin Zachary Clark, 26, of Butler, apologized to the court before he was sentenced to serve one year minus one day to two years minus one day in the Butler County Prison followed by 48 months of probation and to complete 50 hours of community service in a plea agreement.
Butler police charged Clark with felony counts of discharging a firearm in an occupied structure and two counts of aggravated assault, and one misdemeanor charge of reckless endangerment following the Sept. 10 incident.
According to police, Clark went to a man’s North Main Street apartment looking for someone who wasn’t there. After a brief conversation, the man in the apartment turned away toward his bedroom while Clark was still standing near the front doorway. Police said when the man turned back around, he saw Clark pointing a firearm at him.
Clark fired and the bullet hit the ground near the man’s feet inside the apartment. Police said the round landed so close to the man that he thought he may have hit his toe. Clark then fled the apartment.
