Butler man sees third case related to solvents

BUTLER TWP — A Butler man waived his right to a preliminary hearing Thursday, within the same week a third active case was filed against him.

All three cases against Colin S. Kelly, 41, of Butler, involve solvents in some way.

Free after posting $50,000 bond, Kelly appeared Thursday before District Judge Kevin O’Donnell related to a case filed May 9.

Kelly, the son of U.S. Rep. Mike Kelly, R-16th, waived his right to a preliminary hearing involving charges including felony DUI involving solvents and two traffic violations. The same case had been filed by Butler Township police on Feb. 25, the day of the alleged offense, but it was withdrawn May 5 and refiled four days later.

According to the May 9 charges, police found Kelly had driven his vehicle into a wooden real estate sign near the intersection of New Castle Road and Point Plaza, Butler Township.

Police said they found Kelly in the driver’s seat huffing from a canister.

Police said they observed Kelly “raise the can of duster to his face numerous times,” and Kelly ignored all of the officer’s commands ordering him to exit the vehicle.

Kelly later refused to have his blood tested but admitted to officers that he was huffing, police said.

The Feb. 25 incident occurred a day after a similar incident for which Kelly saw charges filed April 12, including three felony counts of DUI involving a solvent and one misdemeanor count of possessing a solvent for huffing.

Police said they were called to the parking lot of a business on Evans City Road where they found Kelly slumped behind the wheel of his vehicle, which was wedged with its front bumper against the side of the building.

“The Hyundai’s engine was running, and it was in drive,” police said.

Police said Kelly appeared confused and reacted the same way to police as he would the following day.

Police said Kelly refused to open his window or exit the vehicle after ordered to numerous times, continued to ignore police commands and “started huffing or inhaling from a can of electronic duster that he held in his right hand.”

Following his Feb. 24 arrest, Kelly did submit blood for testing, police said, citing in charges the results, which included difluoroethane, methadone and fentanyl.

Difluoroethane is a colorless, odorless gas found in pressurized canisters.

Kelly had been on unsecured bonds on both cases but was arrested again May 23 for allegedly violating his pretrial supervision. Following his arrest, Kelly was brought before O’Donnell, who issued the cash or surety bond of $50,000.

The May 23 incident led to charges filed May 25 by Butler City police, including one misdemeanor count of huffing solvents.

Police said at 12:09 p.m. May 23, officers were requested for a welfare check on Kelly. Police said Kelly’s mother called probation after finding her son unconscious on an upstairs couch.

Police said they found Kelly in a similar state when they arrived.

“Colin was slumped forward while sitting on the couch and was cradling a can of keyboard duster that was pointed toward his face,” police said. “He was drooling heavily which is indicative of huffing aerosol spray.”

With Thursday’s waiving, both DUI cases against Kelly have moved forward to Butler County Common Pleas Court. A preliminary hearing has yet to be scheduled for the case filed Tuesday.
