Felony charge withdrawn against Butler man who waived hearing

The most serious charge against a Butler man, who was charged with threatening to kill a woman, was withdrawn and he waived his preliminary hearing Monday.

A felony count of aggravated assault was withdrawn against Carlos M. Fuentes, and he waived the remaining charges, including an added misdemeanor charge of evading arrest on foot.

Fuentes’ bond was reduced from $100,000 to $20,000. He has been held in the county jail since his March 30 arrest.

Assistant District Attorney Ben Simon told District Judge William Fullerton that, after speaking with the alleged victim, he could not meet the legal standard for the aggravated assault charge, but could for the remaining charges.

Simon withdrew the aggravated assault charge and added the misdemeanor charge. He agreed to lower Fuentes’ bond but maintained that he have no contact with the alleged victim as a condition of bond.

Butler city police arrested Fuentes following an incident on West Wayne Street.

According to court documents, Fuentes threatened to behead the woman in front of police and to light a West Wayne Street house on fire by burning a Bible.

Officers responded to reports of an altercation around 8:37 a.m. and encountered the woman, who told them Fuentes had threatened her.

While she was interviewed on the street, police said Fuentes jumped from a second-story window of the home to a neighboring house’s roof and then to the backyard in an attempt to escape.

Police said Fuentes was found hiding in a stack of tires in a yard on Virginia Avenue, which runs parallel to West Wayne Street.

The incident began when Fuentes woke up angry and the woman asked him why he was angry, the woman told police. Fuentes allegedly grabbed a large knife from the kitchen, held it knife to her face and neck and threatened to kill her, police said. When the woman said she was calling police, court documents show Fuentes said, “Good, I will chop your (redacted) head off in front of them.”

Fuentes hit the woman in her face when she attempted to leave and said he would burn the house down, before he lit a Bible on fire inside the home, according to documents. The knife and burned Bible were discovered inside the residence, police said.
