A Butler man suspected in two burglaries, including one at a church, will be released from Butler County Prison onto house arrest, pending the disposition of his case, due to medical issues.

Tyler D. Smith, 32, was released by President Judge Thomas Doerr after testimony regarding the medical issue he suffered while in prison.

Smith testified that on Dec. 15 he passed out while getting routine blood work. When Smith awoke he found the left side of his face was drooping, as well as numbness in his left arm and foot.

Smith said he was taken to the emergency room where they diagnosed him with Bells Palsy, a form of temporary facial paralysis resulting from damage or trauma to the facial nerves, according to the National Institute of Neurological Disorders and Stroke.

Smith testified that doctors recommended further blood work and lab testing, as the underlying reason for the condition had not been diagnosed. But Smith said he is unable to get that treatment or physical therapy to repair the muscles in his face while in jail.

“There has been no follow up,” he said. “The doctors told me I would need to see someone within a few days, but it has been over two weeks and I haven't seen anybody.”

Smith's attorney, public defender Charles Nedz, asked for pretrial supervision, including house arrest with electronic monitoring so that Smith can properly receive these treatments.

Doerr's order releasing Smith states that he will be released Friday onto house arrest with monitoring allowing him only to leave for medical appointments. He ordered Smith to take no medications other than those prescribed for the condition, and no one other than residents are permitted to enter the home in Butler where he will be residing with his mother.

Smith had been held on a total of $25,000 bail since Nov. 16.

He is facing charges of felony burglary, forgery, misdemeanor theft by deception and theft after an alleged incident at the Covenant Presbyterian Church on East Jefferson Street sometime overnight May 5 or 6, 2016.

Butler City police investigators suspect Smith broke a side window to get into the building. According to court documents, he then stole the pastor's personal checkbook and allegedly forged a $1,500 check.

Smith was picked up by police on Aug. 1, 2016. At that time, he was allegedly found with two stamp bags of suspected heroin, two empty stamp bags, a crack pipe and syringe, and is facing misdemeanor possession of a controlled substance and possession of drug paraphernalia charges in that incident.

He was later released on his own recognizance after bail was reduced.

Smith is also facing felony burglary, misdemeanor criminal mischief, possession of drug paraphernalia and summary driving on a suspended license after an incident at his grandparents' house in the 300 block of Center Drive, Oakland Township, on Feb. 24.

Following a burglary alarm state police said they found a broken master bedroom window in the back of the house. Police said the residents suspected Smith had committed the act.

Images taken from a trail camera showed a white van in the driveway, matching the description of the vehicle Smith was known to be driving.

Police went to his home on North Chestnut Street where they found him seated in a white van that looked like the one in the photos taken by the camera.

He admitted he used a BB gun to smash the window at his grandparents' house. The gun handle broke off in the break-in. Troopers recovered the handle from the floor of the bedroom, documents said.

Smith said he fled the house when he heard the alarm. While speaking to police, he admitted he had a drug-smoking pipe in his pocket.

He was placed in Butler County Prison on $10,000 bail. Four days later, his bail was reduced to $3,000 with pretrial conditions attached, and was posted Feb. 28.

Smith was then charged with felony possession of contraband by an inmate and misdemeanor possession of drug paraphernalia after an incident at the Butler County Prison on April 11.

Butler City police said while questioning Smith about an ongoing investigation, they learned he was wanted on a bench warrant for not showing up for court dates.

While being booked, he was allegedly found in possession of two stamp bags of suspected heroin in his wallet.

Smith is currently awaiting court proceedings on those cases.
