Gun lands man in jail
BRADY TWP — A man is accused of pulling a handgun on another man over the weekend at a trailer park in the township.
State police arrested Burton F. Kelly III, 30, on felony assault and weapons charges stemming from the incident Sunday night at the Brady Hills Mobile Home Park.
Police said Kelly, who lives at the trailer park, was in his car about 8:40 p.m. when he allegedly pulled a 9 mm pistol on the other man, who was visiting a friend at the park. No one was injured.
An altercation happened earlier that night when the defendant, while driving his car in the mobile home park, came upon the alleged victim's pickup truck that was partially blocking the road, according to court documents.
Kelly admitted that he blew the horn to get the truck to move, police said. But the alleged victim recounted that he was already moving the truck when Kelly tooted the horn.
The defendant drove away but returned after stopping at a store. The alleged victim acknowledged that he followed Kelly's car because he “wanted to see what was wrong” from the previous incident, documents said.
The truck driver said he pulled along side the car and asked what was the matter. A friend and two children were also in the truck.
According to Kelly's account, he believed the truck was following him and he pulled his pistol, telling the occupants to “go away,” a police affidavit said.
Kelly was arraigned on felony charges of aggravated assault and carrying a firearm without a concealed carry license.
Additionally, he was arraigned on misdemeanor charges of terroristic threats, simple assault, reckless endangerment and disorderly conduct, and a summary charge of harassment.
He was placed in the Butler County Prison on $15,000 bail following arraignment. Kelly's preliminary hearing is set for Aug. 23 at the office of District Judge William O'Donnell in Slippery Rock.
