Man requests dismissal due to lag; trial scheduled

A Butler man accused of threatening children with a gun requested a county judge dismiss the case against him, citing a state law promising speedy trials.
Judge Timothy McCune instead responded by scheduling a trial for the man this month.
Timothy J. Krick, 57, yelled at children waiting at a bus stop to get off his property, even though witnesses stated they weren't on his land, according to court documents. City police filed charges April 27, 2018, after Krick allegedly armed himself with a gun during the incident.
The case had since lagged in court, leading to Krick's public defender, Charles Nedz, to ask McCune to dismiss the case. Nedz cited Rule 600, a state law guaranteeing a trial within one year of charges being filed.
In response, McCune scheduled the trial for July 11.
During Krick's preliminary hearing in May 2018, a father — Peter Schmitt — testified that he had to attack a gun-wielding Krick before calling 911.
Schmitt testified Krick started yelling at a group of students and adults to get off his property while he was walking his dog, and then went into his house and returned with a rifle.
