SUMMIT TWP — A 39-year-old man is accused of intentionally ramming his car into another vehicle to push it off a road and down an embankment.

John J. Halagich of Old East Butler Road on Thursday was charged with, among other things, felony assault with a deadly weapon, namely his car.

According to court records, victim Sunny Cousins told investigators the incident occurred at 4:49 a.m. April 26 after she pulled her vehicle over to get mail from the mailbox at 155 Old E. Butler Road.

According to court records, Cousins told police she heard another vehicle approaching so she moved her vehicle, a Chevrolet Suburban, away from the mailbox. But as she pulled away, the passing vehicle struck her driver’s side rear quarter panel. Her vehicle slid off the road and got stuck on an embankment, according to court records.

Halagich, the alleged driver, then approached Cousins, who was still in her vehicle, used vulgarity and hit her in an attempt to get her out of her vehicle, according to court records.

At that time, a neighbor, who is not identified in the court records, was leaving for work and saw the incident, police said. The neighbor allegedly saw the defendant’s car “push the vehicle off the road way with his vehicle,” according to court records.

The witness told investigators that he saw Halagich approach Cousins in her vehicle and hit her.

The neighbor allegedly yelled for Halagich to stop.

And at that time, Nicole M. Saeler, who was a passenger in Halagich’s vehicle, allegedly approached the neighbor and “came at him attempting to swing on him,” court records say.

Police were called, and the alleged assaulters drove away.

Both Halagich and Saeler, 43, of 721 Center Ave. in Butler are charged with felony aggravated assault, simple assault, reckless endangerment and harassment.
