Insurance company sued over motorcycle crash injury compensation
A Butler County man is suing his vehicle insurance company over compensation for serious injuries he sustained in a motorcycle crash.
Alexander Kukieza, of Zelienople, filed the suit against his insurer, Progressive Insurance Company, saying his injuries and damages exceed his insurance policy limit and the $50,000 liability payment he received from the insurance company of the driver that struck him combined.
The crash took place July 5, 2025, at the intersection of Lookout Avenue and Portersville Road in Lawrence County, according to court documents. Kukieza filed the suit May 19 in Butler County Common Pleas Court.
A vehicle driven by another man failed to yield the right of way, proceeded into the intersection without clearance and struck Kukieza’s motorcycle, according to the suit. Kukieza was thrown from his bike, hit the windshield of the man’s vehicle and was airlifted to UPMC Presbyterian after being transported from the scene, according to the suit.
He said he sustained a traumatic brain injury that included intracranial bleeding, fractures to the middle section of his spine including fractures at two vertebra, bilateral pelvic fractures, cuts, scrapes and bruises.
The other driver’s insurance company paid Kukieza $50,000, but he said that isn’t enough to fully compensate him for the injuries and damages he sustained as a result of the crash. In response, he filed an under-insured motorist claim against Progressive.
He claims his injuries and damages were the result the negligence and carelessness of the driver of an under-insured vehicle, which entitles him to the under-insured motorist benefits in his policy.
The driver of the other vehicle is under-insured, according to Kukieza’s insurance policy, because the bodily injury liability coverage limits of the other driver’s insurance is less than the amount and value of Kukieza’s injuries, according to the suit.
Kukieza’s policy includes $50,000 per person and $100,000 per accident in under-insured motorist benefits. He claims he and Progressive agree he is entitled to recover compensatory damages from the owner or driver of the under-insured vehicle, but do not agree on the amount he is legally entitled to recover, according to the suit.
He said Progressive is liable to compensate him for his injuries and damages that exceed the amount he received from other driver’s insurance. Kukieza claims Progressive owes him up to the amount of his under-insured motorist coverage, which is $150,000. He is demanding a jury trial.
