Parents sue day care over child’s injuries

The parents of a boy are suing a day care center, its owner and two employees over a broken arm that the parents said the child suffered at the center in 2023 when he was 6 months old.

In a three-count suit filed June 5 in Common Pleas Court, parents David DiGiacomo and Karlee Quinn are seeking damages exceeding $35,000 from Sheryl Buffington’s Daycare & Preschool Palace in Center Township, Buffington and employees Taylor Titley and Megan Anthony.

Titley and Anthony also are facing criminal charges stemming from the same alleged June 13, 2023, incident in which the boy was injured.

The suit claims the boy was under the supervision of Titley and Anthony when Titley caused him to fall forcefully to the ground resulting in an oblique fracture of the right ulna.

Anthony observed Titley’s negligent and reckless actions toward the boy and other children at the center and failed to report it, according to the suit.

The incident was not reported to the boy’s parents, and the injuries weren’t discovered until DiGiacomo picked up his son from the center later that day, the suit claims.

The suit alleges negligence and negligent supervision against each defendant, and corporate negligence against the day care center and Buffington.

A representative who answered the phone at the center Thursday declined to comment on behalf of the business and Buffington citing advice from an attorney. Titley and Anthony couldn’t be reached independently or through the attorney’s representing them in the criminal cases.

Titley, 31, of Lyndora, has been charged by state police with five counts each of felonies aggravated assault and child endangerment; and misdemeanor simple assault and reckless endangerment. Anthony, 26, of Butler is facing four counts of person required to report suspected child abuse. Both cases are pending in Common Pleas Court.
