Hearing held for Ohio man accused of raping teen

A prosecutor and a defense lawyer argued Friday over the relevance of an Ohio University investigation into sexual harassment allegations against a man being held in Butler County Prison for a rape charge.

Tray Roland Eisenbraun, 18, of Poland, Ohio, faces charges of rape by forcible compulsion, a first-degree felony, and criminal use of a communication facility, a third-degree felony, after police said he traveled from Youngstown to Cranberry Township on May 13, 2019, to meet the teenage girl, whom he met on the social media site Instagram.

As part of Assistant District Attorney Robert Zanella's case, he asked Common Please Judge William Shaffer to permit a video be used from an unrelated issue. The video, according to Zanella, depicts a Youngstown State University investigator interviewing Eisenbraun about several allegations made by women accusing Eisenbraun of sexual harassment.

But Eisenbraun's lawyer, Matthew Mangino, argued Friday that the video shouldn't be permitted because Eisenbraun never was read his Miranda rights during that incident.

Zanella agreed, but said Eisenbraun signed a consent form to the interview. Shaffer said he would make a decision after reviewing the case.

The hearing was attended by the victim and her family, along with members of Eisenbraun's family.

Zanella called Sgt. Matthew John Irvin on Friday to recount the investigation. Mangino immediately objected to Irvin's testimony, arguing that what he said was hearsay based on his conversations with the victim. Instead, Mangino suggested that the victim take the stand since she was present. Shaffer overruled the objection, allowing Irvin to continue his testimony.

Irvin said the teen thought she was going to a restaurant when Eisenbraun drove her to Cranberry Woods Drive. Instead, Irvin said, Eisenbraun stopped in a large parking lot, where the two took a photo together and began consensually kissing. Things quickly escalated, Irvin said, when Eisenbraun climbed into the passenger seat and removed the victim's underwear.

The victim told Eisenbraun that she was a devout Roman Catholic and was waiting to have sex until after marriage. Irvin said Eisenbraun raped her as the victim said “no” at least three times and attempted to push him off her. Irvin said the victim told the officer that the incident was painful and afterward she was in a state of shock.

After Eisenbraun was done, Irvin said, he dropped her off near her house.

On Jan. 9, police charged Eisenbraun after they were notified in September of the alleged incident after a call to the child protective services hot line ChildLine. They executed search warrants, including online phone application records from Eisenbraun's phone.

There, they found a chat log between Eisenbraun and the victim made after the alleged rape. During the chat, Eisenbraun complained that he was losing friends and not making new ones. He told the victim he cared about her and loved her.

“I'm still a nice person,” Irvin recalled Eisenbraun writing.

The victim told Eisenbraun that she didn't want to have sex with him when he allegedly forced her, and it hurt her.

“You'll always be my friend,” Eisenbraun wrote, according to Irvin. “I hope someday you could forgive me and we could go T.J. Maxx shopping or something.”

Eisenbraun is being held at the Butler County Prison on $250,000 bail.
