Man sues Brick House over 2021 assault
A Butler Township man whose jaw was broken in an assault outside of the Brick House in Butler in November 2021 is suing the restaurant for failing to provide adequate security and serving guests who were intoxicated.
James Joseph Raab filed the suit last week against Hill Boys Inc., which does business as the Brick House, and owner Larry Goettler, seeking unspecified damages in excess of the arbitration limit of $35,000.
Attorney Tom Breth is named as a co-owner and defendant. Breth said he was one of the original owners when the restaurant opened, but he hasn’t had an ownership interest in 15 years. Goettler could not be reached for comment.
Isaiah Louis Devaughn, 27, of Butler, pleaded guilty to a felony charge of aggravated assault that Butler City police filed against him for assaulting Raab, and was sentenced in September of this year to serve 6 to 12 months in jail followed by 24 months of probation. Devaughn also was ordered to pay Raab $40,120 in restitution.
Co-defendant Antonio Djour Devaughn, 24, of Butler, pleaded guilty to simple assault and was sentenced in June to 30 days of house arrest followed by 18 months of probation.
Police said in an affidavit that surveillance video showed Raab was assaulted from behind by one man and then struck in the face by another man while he was backing away from the first man. Police said the surveillance camera captured the initial events of the assault. The incident took place Nov. 25 outside the restaurant on Main Street. Raab also lost several teeth in the assault, according to the suit.
In the suit, Raab claims the restaurant failed to provide adequate security, failed to properly train security personnel, failed to appropriately control the crowd, failed to disperse patrons who had been kicked out of the building, and overserved alcohol to already intoxicated guests.
