Woman charged with wiretapping related to custody battle
A Butler woman has been charged with felonies after detectives said she livestreamed a custody hearing on social media.
Butler County detectives filed charges last week against Samantha C. Byers McGee, including felony counts of intercepting communications and disclosure of intercepted communications as well as misdemeanor unlawful use of recording devices in court.
According to charging documents, detectives began investigating after viewers of the Facebook post reported seeing the May 23 Butler County Court custody proceeding conducted through the Zoom Meetings platform.
“During the Zoom Meeting, the plaintiff took it upon herself to livestream the court proceeding via her Facebook profile, making it available to all of her Facebook friends,“ said detectives in charging documents.
Detectives estimated more than 500 people saw the livestreamed hearing, which they had seen posted on the profile as of June 17.
During a search Sunday, the video no longer appeared to be posted on the profile.
Detectives said they interviewed the custody conciliator, who led the meeting.
“(She) explained that prior to each hearing, she verbalizes a preamble, instructing each party that they are to be the only party in in the room, unless represented by counsel, and the only party providing testimony,” detectives said.
Detectives said after viewing the livestreamed video, which a witness had preserved, they also could see there were others in the room with McGee during the proceeding, which prompted some of the charges.
Detectives also said “at no time did (McGee) ever request or inform anyone that (the proceeding) would be recorded and posted.”
McGee is scheduled to appear for a preliminary hearing July 25 before District Judge William Fullerton.
