Noise level regulation discussed in Jefferson
JEFFERSON TWP — The township will either move forward with a noise ordinance or specifically regulate off-track vehicles, but not both.
Evelyn Gross, chairwoman of the township planning commission, said at Thursday's meeting the options are to adopt a noise ordinance with a provision dealing with off-track vehicles or enact off-track vehicle restrictions without addressing noise levels.
She said the township cannot single out one type of noise in an ordinance because it would not be enforceable.
"You can't pick and choose," Gross said.
More than 50 people packed the meeting room, spilling into the hallway Thursday.
Resident Bob Corbett of Keck Road supported any ordinance placing restrictions on a proposed racetrack on nearby Neupert Road.
"People have a right to quiet enjoyment," he said.
Resident Brian Thoma countered it was pointless to attempt to regulate noise as a previous attempt in Jefferson was quashed 25 years ago.
"Why are we doing this again?" he asked.
Thoma said it was wrong for people to use proposed ordinances as a way to deter the racetrack. He recalled the previous noise ordinance proposal was geared to shut down a car crusher business.
"No one should stop anyone from doing anything on their own property that is not hurting anyone (else)," he said.
The planning commission agreed if a noise ordinance would be adopted, there would be exemptions, such as fireworks for events, church bells and farm equipment.
Leo Rosenbauer, planning commission member, said he preferred adding off-track vehicle regulations to the township code. "I hate to adopt a full-blown noise ordinance," he said.
If the township adopts off-track vehicle regulations, those limitations could be added to a nuisance ordinance.
Gross said the township supervisors will decide what direction the planning commission should take.
