BUFFALO TWP — A Clearfield Township woman faces a hearing later this month on charges she was high on marijuana while her infant daughter was in the back seat of a car in August, when she was arrested for drugged driving.

Brittany N. Bates, 27, is charged with driving under the influence of a controlled substance, child endangerment and possession of a small amount of marijuana and drug paraphernalia.

State police said they found Bates at about 12:45 p.m. Aug. 22 in a car parked on the roadside with its hazard lights blinking on Route 28 north in Buffalo Township.

A trooper stopped and noticed the vehicle's registration and inspection sticker were both expired, according to court documents.

He also smelled marijuana coming from the car and suspected the defendant and her passenger, Joseph D. Oswalt, 25, of Butler, were impaired. Both allegedly admitted to having smoked marijuana an hour earlier.

Bates' then 6-month-old daughter was also riding in the car, police said. She was in the back, in a child safety seat.

During their investigation, police learned that Oswalt was wanted on a bench warrant. He was arrested and a subsequent search found him with a hypodermic needle and spoon with suspected heroin residue on it.

Bates was arrested after failing field sobriety tests. She was later taken to ACMH Hospital in East Franklin Township, Armstrong County, for a blood test. Police said toxicology reports showed she had marijuana in her system.

A search of the car, documents said, turned up marijuana and a marijuana pipe.

Preliminary hearings for Bates and Oswalt, who is charged with possession of drug paraphernalia, are set for Dec. 20 at the office of District Judge Sue Haggerty in Saxonburg.
