Defense’s effort to dismiss homicide case denied
A motion requesting the dismissal of a homicide charge against a Chester County man accused of a 2021 Butler County murder was denied less than a week before jury selection is scheduled to begin.
An attorney representing Paris Carter, 28, of Downingtown, who is charged in the shooting death of David A. Hines, 38, of New Castle, filed the Rule 600 motion Nov. 3 requesting dismissal of the charges. In a Rule 600 hearing, a judge decides if a defendant’s constitutional right to a speedy trial has been violated.
The Rule 600 motion defense attorney Matthew Ness filed on Carter’s behalf states the “run date,” which is the day the 365-day clock starts in which a trial must occur, has changed seven times due to delays from continuances and appeals since the charges were filed. He said the current adjusted run date of Oct. 15 falls before the trial date.
Common Pleas Judge Joseph Kubit denied the Rule 600 motion Friday, Nov. 6. Jury selection is scheduled to begin Thursday, Nov. 12.
Carter has been held in Butler County Prison without bail since he was arrested May 26, 2021, in Philadelphia. Hines was killed May 17, 2021.
A passerby discovered Hines’ body in the still-running vehicle, wedged into a hillside along Portersville Road in Muddy Creek Township.
