Slippery Rock man gets jail time for 3rd DUI offense
A Slippery Rock man was sentenced Wednesday, May 3, to serve 15 to 60 months in state prison for his third driving under the influence offense that state police filed after he sideswiped a car in Slippery Rock Township in October 2020.
In addition to his prison sentence, Brian Joseph Miller, 34, was fined $3,500 and ordered to complete 40 hours of community service and participate in a victim impact panel. His sentence also included paying $11,231 in restitution to Spectrum Insurance Services of Mars and $1,000 to Diann Morse, whose car he struck.
Butler County Common Pleas Court Judge Kelley Streib imposed the sentence after Miller pleaded guilty to his third DUI offense and driving with a blood alcohol content of 0.02% or greater with a license suspended for DUI-related reasons.
The sentence was ordered after Morse, a retired drug and alcohol treatment therapist, recounted the crash in a victim impact statement.
“Mr. Miller, you made the wrong decision. It is time for you to get clean and sober,” Morse said to Miller, who attended the sentencing hearing remotely from the county prison, where he is being held on unrelated charges.
She warned him that the consequences of another DUI crash could be worse.
Morse said the crash took place in front of her home on Route 173. She said she stopped her car to allow traffic to pass so she could pull into her driveway when Miller sideswiped her car. She said her car was a total loss.
In her car mirror, she said she saw Miller’s vehicle approach at a high rate of speed and braced herself for impact. She said one of the wheels of Miller’s vehicle flew off as a result of the impact. She said Miller did not have auto insurance or a driver’s license at the time.
Morse said she lost her $1,000 insurance deductible and had to replace her car with a used one because she couldn’t afford a new one due to the cost of her husband’s medical bills.
