Lawsuit alleges apt. floor gave way, causing injury to woman

A Mercer County woman is suing the owners and manager of a Slippery Rock apartment complex claiming she was injured after partially falling through a rotted wooden floor in an apartment.

Linda Dadzaa, of Grove City, is seeking unspecified damages and a jury trial in the suit filed Wednesday against the owners and manager of Madison Grove Apartments in Butler County Common Pleas Court.

On June 4, 2020, Dadzaa said she was an invitee in apartment 603 when she was walking in the kitchen and her right leg fell through the floor, causing her to fall, according to the suit.

There was a leak in the kitchen that caused the wooden floor to rot, crack and buckle, creating a dangerous, defective, hazardous and unsafe condition, she claims in the suit.

As a result of the fall, the woman said in the suit, she suffered injuries to her lower and upper right extremities, right hip and back. She said she has endured pain, inconvenience, embarrassment and mental anguish; lost earning capacity and has paid for medical treatment, medical supplies, medicine and rehabilitation.

Dadzaa claims the building owners and manager were negligent for not repairing the floor; not warning users about the floor; failing to respond to tenants’ complaints about dangerous conditions; not hiring experienced maintenance personnel to inspect, repair and maintain the premises; designing, constructing, maintaining and operating the premises in a way that allowed Dadzaa to fall; failing to cordon off the area; and other allegations.

Named as defendants are the owners, Madison Grove LLC and WODA Cooper Companies Inc. of Columbus, Ohio, and property management firm WODA Management and Real Estate of Columbus, Ohio. Neither Madison Grove or WODA Cooper could be reached for comment.
