Slippery Rock man sues mobile home park over trip, fall injury
A Slippery Rock man is seeking more than $75,000 in damages in a lawsuit he filed against the owners of the mobile home park where he lives over a trip-and-fall accident in February that he claims left him with several fractured bones.
Don Ernst, who lives on Marigold Lane in the Brady Hills Mobile Park, filed the suit against the park’s owners and operators in Butler County Common Pleas Court.
The suit alleges that Ernst tripped and fell Feb. 24 due to a man-made hole dug near his home, resulting in him suffering several serious injuries, including but not limited to, a fractured pelvic bone, ankle and head.
The hole was not sectioned off and did not have caution signs, which created a dangerous condition on the pathway on the premises, according to the suit that was filed April 13 by attorney Marc Simon of Newton Square in Delaware County.
All or some of the injuries could be permanent, and have caused pain, permanent scarring, emotional injuries and loss of earnings and earning capacity, according to the suit. Ernst is seeking a jury trial.
The suit claims the defendants were negligent by failing to design, build and maintain walkways that residents are likely to use; failing to provide sufficient warnings of defects; failure to erect barricades; and failure to exercise proper care of the premises.
Named as defendants in the suit are the Peter Rabbit Campground and MCH Capital LLC, which does business at Brady Hills Mobile Home Park, 153 Lilac Lane in Slippery Rock. Also named as defendants are Judy Carlson, manager, MHC Affordable Housing of Los Angeles, and MHC Capital LLC, Brady Hills MHC LLC and Brady Hills Developer LLC of Bloomfield Hills, Mich. Carlson and MHC Capital could not be reached for comment.
The defendants haven’t responded to the suit, which has been assigned to Senior Judge Robert Yeatts.
