Boater charged with being intoxicated

A Lake Arthur boater is accused of being more than twice the state's legal limit for alcohol — for driving — at Moraine State Park in Muddy Creek Township.

The Pennsylvania Fish and Boat Commission on Monday charged Nicholas D. Stone, 32, of Butler, with operating a watercraft under the influence, and several boating violations.

Two waterways conservation officers for the commission, while on boat patrol, spotted Stone about 3 p.m. May 24 on a 16-foot motorboat near the Old Route 422 access area, authorities said.

The officers noted that the defendant was operating the craft while standing at greater than slow, no wake speed — a boating violation. Two passengers were also on the boat.

The officers came up along the side of Stone's craft and subsequently noticed open cans of beer in two cup holders and another crushed beer can on the deck, authorities said. Stone also allegedly smelled of alcohol.

While conducting a safety and equipment inspection, the officers said they noticed a large uncapped bottle of vodka that was two-thirds empty. Stone eventually was arrested for suspicion of drunken boating.

Stone was taken to the Slippery Rock University police station for a breath test, which showed his blood-alcohol level was 0.183 percent, according to charging documents. In Pennsylvania, a level of 0.08 percent is considered intoxicated for drivers.

A preliminary hearing was not immediately scheduled. Online court records did not indicate if Stone has an attorney and he could not be reached for comment.
