Former councilman's sentencing delayed
A county judge Wednesday postponed the sentencing of a former Prospect councilman — guilty of touching a boy — citing the absence of the assigned prosecutor.
David Stellfox, 73, of Prospect pleaded guilty Feb. 4 to misdemeanor corruption of minors and indecent exposure, and in exchange Assistant District Attorney Terri Schultz agreed to drop identical felony charges. Under the plea deal, Stellfox will serve two years of probation. The victim's family attended Wednesday's sentencing, but Common Pleas Judge Timothy McCune declined to sentence Stellfox, explaining to the defendant and his lawyer, Michael Zunder, he didn't feel “comfortable proceeding with the case without the assigned ADA.”
Schultz is out all week, according to the district attorney's office.
Records from the Butler County Bureau of Elections reveal Stellfox was appointed to the Prospect council in February 2010, served until 2011 and was then elected to serve from 2011 to 2015. Butler State Police filed charges against Stellfox three years later in January 2018. He was briefly held in Butler County Prison in lieu of $50,000 bond before posting bail in early February that same year, according to court documents.
Police said a forensic interview was conducted by the Butler County Child Advocacy Center with an 11-year-old boy, who reported that Stellfox inappropriately touched him and forced him to inappropriately touch Stellfox, according to the affidavit.
The boy said the incidents occurred about 10 times per year, over a two- to three-year period, according to the document. The victim also said Stellfox told him not to tell anyone about the incidents.
During an interview, Stellfox admitted some contact with the boy on several occasions, police said.
“Stellfox said he was experiencing uncontrollable impulses when these incidents occurred and knew his actions were wrong,” Trooper Christopher Balcik wrote in an affidavit, “He described his urges caused him to commit these acts for sexual gratification.”
