EVANS CITY — A man no longer will face felony charges in connection with a domestic dispute during which he allegedly wielded a pocket knife last month in Adams Township.

Prosecutors withdrew the most serious charges — two counts of aggravated assault — against Daniel R. Wehner, 55, of Adams Township, at his preliminary hearing Tuesday at the office of District Judge Wayne Seibel.

Wehner waived to court lesser charges — two counts each of simple assault and harassment — in the same case.

In a separate case, he also waived charges of driving under the influence.

Adams Township police initially charged Wehner after they were called June 9 for a domestic incident at his ex-girlfriend's home on Sunny Hill Drive.

The woman told police that earlier in the day she had told the defendant to “move out” of the home where the couple had been living together. She called her ex-husband to come over and change the locks.

The former husband said that as he was changing the locks, Wehner “came running at me with a knife and attempted to stab me,” according to court documents.

When his ex-wife tried to intervene, he recounted, the defendant “continued swinging the knife and cut her right arm,” documents said. Police described the injury as a nonbleeding “abrasion.”

Wehner fled in a car, police said. Officers obtained an arrest warrant and eventually stopped him in the vehicle around 10:50 p.m. June 12 when he returned to the home.

He subsequently was taken to UPMC Passavant hospital in Cranberry Township for a blood test, which showed his blood-alcohol level was 0.226 percent. In Pennsylvania, a level of 0.08 percent is considered intoxicated.

Wehner's attorney, Joseph Charlton, said after Tuesday's court proceedings that the state withdrew both counts of aggravated assault in the domestic incident after determining the alleged crime did not rise to the level of that offense.

He declined further comment about either case.

Amanda Scarpo, a county assistant district attorney, was unavailable immediately after the proceedings, and she did not return a telephone call later Tuesday.

Wehner is free on $10,000 bail. At the request of the woman involved in the domestic incident, Seibel lifted a no-contact order between her and the defendant. The no-contact order between Wehner and the other victim remains in effect.
