PENN TWP — Yet another criminal case has been filed against a tree-trimming service owner suspected of defrauding numerous homeowners in Butler and Allegheny counties.

Penn Township Police last week charged Jeramiah V. Cubarney, 28, of Gibsonia with home improvement fraud, a felony, and theft by deception, a misdemeanor.

He is accused of taking a $500 down payment from a woman on Oct. 19 to complete a tree trimming and removal project at her home in the 300 block of Dinnerbell Road. But no work was ever done, according to court documents.

The alleged victim notified police Nov. 8. Police filed charges Nov. 15.

Cubarney is already facing four home improvement fraud cases in Butler County — three in Middlesex Township and one in Cranberry Township.

Additionally, he is a defendant in more than a dozen similar cases in Richland, Hampton and McCandless townships, and Fox Chapel, all in Allegheny County.

Following his arrest in October on felony charges in Allegheny County, investigators contacted local police departments in surrounding counties to identify other possible victims.

Cubarney, owner of Cubarney Tree Service, was charged Oct. 5 in Middlesex Township with accepting $1,500 from a Keithwood Drive resident to clean up storm damage and haul away logs, but never performing the work.

Middlesex Township police on Oct. 31 filed two additional cases.

A homeowner on North Drive paid Cubarney $500 in May to trim and remove trees on the property, documents said. The resident told police that the defendant called him about 30 days later to say that he was injured, but he never returned the money or did the work.

An Overbrook Road homeowner told police that she paid Cubarney $1,100 in March 2016 to cut down two pine trees and trim another tree. He cut down the pines, she said, but never returned to trim the other tree.

He is awaiting trial in the Middlesex cases.

Cranberry Township police on Sept. 21 charged him in a similar fraud case dating back to December 2016. A preliminary hearing is set for Jan. 12.

In the Butler County cases the charges include deceptive business practices, theft by deception, receiving stolen property, and receiving advance payment for services and failing to perform.

In Allegheny County, he is facing preliminary hearings Jan. 24 in connection with 11 home improvement fraud cases there, primarily in Hampton Township.

Trials are pending in three other Allegheny County cases.

Cubarney remains free on non-monetary bond with the condition that he has no contact with the victims and that he enters an out-of-state, in-patient rehabilitation center.
