CHICORA — A 21-year-old man has been ordered to stand trial in a case charging him with raping two girls at a Center Township home last year.

District Judge Lewis Stoughton at a preliminary hearing Tuesday ruled there was sufficient evidence to hold Austin Chalmers Miller of Center Township for court in the case.

State police on Jan. 27 arrested Miller on charges that he sexually assaulted the alleged victims, ages 14 and 15, at the home of one of the girls in December.

He remains free on $150,000 bail.

Trooper Max DeLuca, who investigated the case, was the only witness to testimony at the hearing.

While DeLuca admitted that he never interviewed the girls, he observed a forensic interview with the alleged victims at the Butler County Alliance for Children facility.

Both victims told authorities that Miller, who they knew, on Dec. 15 came to the home of the younger girl with alcohol that they all drank, the trooper recounted.

The 14-year-old recounted that later while she and the older girl were in a bedroom sleeping on the same bed, the defendant entered the room and got in the bed.

She said she saw Miller get on top of the 15-year-old and then noticed the sheets “moving up and down,” DeLuca testified.

The younger girl said the defendant later raped her, too.

During her session with the forensic interviewer, the older girl “confirmed (the 14-year-old’s) statement about the evening,” DeLuca said.

On cross-examination, Miller’s attorney, Michael Zunder, asked the trooper if the girls indicated they tried to resist his client.

According to the younger girl, DeLuca testified, she tried to get out of the bed when Miller was assaulting the other victim. But he told her to lay back down.

“So she just laid back down?” Zunder asked.

“Yes,” DeLuca said. “She complied and remained in the bed.”

The same girl said she later tried to leave a second time but Miller again stopped her. She was unable to say how he prevented her from leaving, DeLuca admitted.

In the trooper’s criminal complaint, the 14-year-old claimed she told Miller to “stop” and she heard the older girl tell him “no.”

The 15-year-old also told investigators that Miller raped her on two other occasions during visits at the same house in December. But she was unclear about specific dates of those other alleged assaults, DeLuca conceded during cross-examination.

Miller is charged with four counts each of rape and statutory sexual assault, and two counts of corruption of minors, all felonies. He also is charged with two misdemeanor counts of corruption of minors.

Additionally, he is charged with two counts each of indecent assault, indecent exposure and furnishing alcohol to minors, all misdemeanors.
