BlueSox owners seek deal

Group claims clause gives right to buy team

The majority ownership group of the Butler BlueSox wants complete control of the team.

Butler attorney William “Wink” Robinson, one of the five partners of the Perfect Game LLP ownership group, which currently owns 60 percent of the club, said the partners met Tuesday night to discuss the City of Butler Parks Recreation Grounds and Facilities Authority’s proposed deal to sell its portion of the team.

Robinson said the group, which also includes Ray Conlon, Dr. Mike Fiorina, Gordon Marburger and Matt Clement, voted unanimously at its meeting to oppose the transfer of the authority’s 40 percent to a third party. The group also decided to seek to acquire the authority’s share of the club for $40,000.

The authority announced Dec. 11 that it reached a deal to sell its 40 percent ownership to the Nonprofit Development Corporation of Butler for $40,000.

The two sides signed the agreement and the deal is pending approval from the Prospect League.

But there is still debate on whether the authority has the power to sell its share to the nonprofit group.

Robinson claims there is a clause in a 2009 joinder agreement between the two sides that states the majority has first rights to any stake up for sale.

Art Cordwell, a member of the authority, said last week that the authority was not aware of such a clause.

Cordwell also said the authority never discussed its interest to sell its stake with the majority ownership before reaching a deal with the nonprofit group.

Robinson said he personally handed over a letter of interest to Leo Stepanian II, the authority’s solicitor, on Wednesday stating the majority group’s desire to buy the remaining stake, but has not heard back from the solicitor or the authority.

He said the next step in the process will depend on the response from the authority and whether it is willing to sell its share to his group.

The majority group may bring in one or two outside investors in purchasing the remaining stake.

Neither Stepanian nor the authority could be reached for comment.

The BlueSox is a Prospect League team for college baseball players. The team played 32 games at Pullman Park in 2013.
