A Slippery Rock man was sentenced to probation in Butler County Court on Thursday after being originally charged with firing a gun at an occupied home.

Erik K. Dubois, 30, was sentenced to 12 months probation and ordered to pay $816.39 in fines and court costs by Judge William Shaffer. He also was ordered to pay $800 restitution after previously pleading guilty to misdemeanor disorderly conduct on Aug. 16.

Dubois was initially charged with felony discharge of a firearm into an occupied structure, firearms not to be carried without a license, two counts of aggravated assault, misdemeanor disorderly conduct, possession of a firearm prohibited, two counts of recklessly endangering another person, summary harassment, criminal trespass and driving on a suspended license after an incident in Venango Township on Sept. 10, 2016.

The remaining charges were dismissed as part of the plea.

Assistant District Attorney Benjamin Simon said the plea agreement was reached because “all the allegations did not match evidence.”

“There were no bullet holes found in the home, and we don't believe any gun was fired at the house,” he said. “The Commonwealth is not convinced by the complainant's allegations or statements.”

The homeowner and another person were inside the house at the time; no injuries were reported.
