FAIRVIEW TWP — A township man is accused of brandishing a semi-automatic rifle and pointing it toward his former girlfriend and their 2-year-old daughter at his home on Route 268.

State police say the defendant, Mark E. Miller, 34, was “highly intoxicated” when the incident occurred between 7:30 and 8:15 p.m. Friday during a domestic dispute on the 1200 block of Route 268, also known as Kittanning Pike.

No injuries were reported. Police later arrested Miller on charges including reckless endangerment, child endangerment, simple assault, harassment and disorderly conduct. He is free on $5,000 bail.

The 22-year-old victim contacted authorities around 9:20 p.m. to report the incident, which occurred after she went to the defendant's home to drop off their child for visitation, according to charging documents.

But she believed Miller was too intoxicated to care for their daughter. At some point, police said, he got an AR-15 style rifle.

The woman described him handling the gun “in a careless and reckless manner,” Trooper Donald Kotuby said in his affidavit, “pointing the muzzle” in the direction of her and the girl.

She left with the child. Police found Miller around 12:05 a.m. Saturday at his home.

Advised of the report, the affidavit said, Miller told police, “I'm not sure why I had (the rifle) in my hands.”

But he later admitted that he was “very angry” with his ex-girlfriend and grabbed the rifle during the couple's argument. He said the rifle was not loaded.

Police seized a Smith & Wesson M&P15 from his home.

He was booked into the Butler County Prison around 4 a.m. Saturday and released several hours later after posting bail.
