SLIPPERY ROCK — The borough was dismissed April 17 from its inclusion as a defendant in one woman's fall case against multiple parties.

Robin Johnston had filed a lawsuit against the borough, Slippery Rock Development and Slippery Rock University in Butler County Court of Common Pleas, for injuries she allegedly sustained in a fall during VillageFest in September 2015.

Attorney Christian Marquis of Marshall, Dennehey, Warner, Coleman and Goggin represented the borough in the matter.

The borough was dropped as a defendant because the fall did not occur on borough property, according to Marquis.

Rebecca Black, the borough's solicitor, said the public was informed at the last two borough meetings of the dismissal.

“Attorney Marquis kept the borough informed about the status of the litigation throughout the case, but neither the council nor I were overly involved otherwise,” Black said.

The dismissal was filed without prejudice, but both lawyers agreed that the evidence proves that the borough should not be implicated in any further lawsuit regarding the situation.

“It's highly unlikely,” Marquis said.

Jeff Parker, Johnston's attorney, was unavailable for comment.
