Inmate, brother charged in escape attempt

The brother of a Mercer County Jail inmate is accused of lying to police about his brother’s escape Sunday, May 10, near Prospect, according to state police.

The inmate, Dustin Phillip Miller, 34, of Slippery Rock, was charged Sunday with felony escape and misdemeanor disorderly conduct. His brother, Joshua David Miller, 35, was then charged Tuesday with two misdemeanor counts of hindering prosecution and one misdemeanor count each of unsworn falsification to authorities and disorderly conduct.

On Sunday, police said Joshua Miller called 911 from the Fairground Market in Prospect to report his brother had escaped. Dustin Miller was picked up that morning from Mercer County Jail by Joshua Miller for a four-hour furlough to get supplies for a work release program starting the next day.

Joshua Miller told police while the two were at the Fairground Market, Dustin Miller exited the vehicle and ran into a tree line with a tan grocery bag of clothes and a phone.

State police and officers from Butler, Butler Township and Prospect aided in the search for Dustin Miller, which included using drones, aviation and a blood hound. He was found in the upstairs bathroom of a residence along William Flinn Highway in Clay Township.

Dustin Miller told police that Joshua Miller made a deal to drop him off at the residence and later take him back to Mercer County Jail, according to an affidavit. Police said Joshua Miller then drove to the Fairground Market and called 911, alleging Dustin Miller had run away.

Joshua Miller told police that his brother had told him he loved him but wasn’t going back to jail before he ran.

Police later contacted Joshua Miller and said he admitted to dropping his brother at the residence and lying about his escape.

Police said Dustin Miller was serving a 1- to 3-year sentence in Mercer County Jail for eluding police. He’s now being held in Butler County Prison on a $250,000 bail with a preliminary hearing scheduled for 1:30 p.m. May 20 before District Judge Joseph Nash.

Joshua Miller’s preliminary hearing has yet to be scheduled.
