Butler man jailed after violent tussle with police

Andrea Lucky

Some tense moments played out this weekend at a Butler home where a man suspected of violating a woman's protective order allegedly head-buttled, kicked and bit police officers, and tried to disarm officers of their weapons, authorities said.

The suspect, following the melee Saturday, later manuevered his handcuffs while in the back of a police car, police said, and allegedly managed to get his hands on the barrel of the cruiser's AR-15 rifle.

Andrea A. Lucky, 34, eventually was subdued and he is facing nine felonies among a list of charges stemming from a pair of incidents at his home on the 200 block of East Brady Street.

He is in the Butler County Prison in lieu $175,000 bond.

Police said Lucky's live-in girlfriend showed up at the station about 4:20 a.m. Saturday to report being assaulted during an argument at the home.

The 32-year-old woman accused the defendant of hitting her in the face and trying to strangle her.

When her 14-year-old son came to her aid, she recounted, Lucky hit him twice in the face. She, in turn, intervened and tried to hold her boyfriend from continuing to assault the boy, police said.

There were at least two other children in the house.

Lucky allegedly bit the woman's finger before brandishing a 9 mm pistol. He is accused of pointing the gun at her, saying, “If it wasn't for the kids being right there, I would shoot you.”

Police in charging documents noted that because of Lucky's prior criminal record, he is barred under state law from possessing any firearms.

He fled the house, police said, allegedly taking his girlfriend's cellphone so she could not call 911.

The woman subsequently went to Butler Memorial Hospital where she was treated for the bite wound on her finger. Her son also complained of facial pain from being struck during the incident.

Later that day, she obtained an emergency protection from abuse order that prohibited Lucky from the house. But that didn't stop him, authorities said.

The woman shortly before noon Saturday called to report a man had broken into her home. Police got there and found Lucky inside. He refused to come out.

Officers eventually kicked in the door, police said. As police moved in toward the suspect, he began swinging his fists at two of the officers. Police said they were able to take him to the floor and got him handcuffed.

But once back on his feet and as he was being escorted out of the house, police said, Lucky head-buttled Lt. Anthony Fatta in the face and head area in a bid to get away.

Police said as they tried to restrain the defendant, he bit Patrolman Myles Bizub on the upper left arm. At one point during the incident he is accused of reaching for another officer's service pistol, and apparently trying to grab it.

Officers again took the suspect to the ground, but he allegedly continued to resist police and tried to bite officers. Shackles ultimately were used to restrain his feet.

Still, while being led off the porch and onto the sidewalk, Lucky continued to pull away from officers, causing an officer's Taser to be dislodged from its holster, police said.

“Lucky attempted to brush away the Taser with his foot,” according to charging documents, “to take control of it.” Officers, however, got the Taser back.

While being placed in the cruiser, police said, the defendant allegedly kicked Sgt. Nicholas Shulik in the groin.

In the back of the car, he was able to slip his handcuffs to the front of his body, allowing him to reach through the glass partition that was partially open.

“Lucky grabbed the barrel of the patrol vehicle's AR-15,” documents said, “and began pulling on it, trying to dislodge it from the rack.”

His attempt failed, police said, but he also snapped the plastic part of the partition.

Bizub and Shulik were back on their scheduled duty Sunday, but Fatta apparently was not. It was not immediately clear if any of the officers were injured or received medical treatment.

District Judge Kevin O'Donnell arraigned Lucky on felony charges of aggravated assault and persons not to possess firearms, and misdemeanor charges of terrorist threats and simple assault in the first incident.

For the second incident, O'Donnell arraigned the defendant on three felony counts each of aggravated assault and attempting to disarm a law enforcement officer, and a felony charge of escape.

Additionally, he was arraigned on five misdemeanor counts of resisting arrest and a summary charge of criminal mischief.
