Charges held for court in sexual assault hearing

A preliminary hearing Tuesday, Nov. 18, was forced to take a recess after a frustrated witness began yelling at the defense attorney when he repeatedly pressed for details about an alleged sexual assault she said she did not remember.

Assistant District Attorney Laura Pitchford issued multiple objections for badgering the witness and threatened to request a continuance for witness intimidation during the hearing.

Defense attorney Duke George Jr. argued the 16-year-old girl’s testimony should be stricken from court records and charges against his client dismissed because she does not remember what transpired in the alleged assault by his client, Derrian Alcorn, 27, of Buffalo Township.

Pitchford argued she had established enough evidence to show the case may have merit, which is the standard at a preliminary hearing to have a case proceed to common pleas court.

The girl testified she met Alcorn about two summers ago on Snapchat before they met in person. She said she was 15 and Alcorn was 26 when the assault allegedly occurred.

She said their conversations started normally before she asked Alcorn to buy her alcohol. She said Alcorn insisted she pay for it by sending him nude images of herself, despite him knowing her age. The girl testified she found a nude photo online and sent it instead. She said Alcorn dropped off Pink Whitney after receiving a photo.

The girl testified she could not remember when their second interaction was, which is when the alleged assault occurred, but she said both interactions occurred within the same month.

The night of the alleged assault, the girl said she was house-sitting with her friend at a home in Freeport. She said she and the other girls at the home had been drinking alcohol.

She testified that, in her intoxicated state, she messaged Alcorn again on Snapchat asking for alcohol. She said she left the house alone and walked to a nearby park in Freeport where she met Alcorn in his vehicle.

When asked by George, the girl testified she was not forced into Alcorn’s vehicle. She said she recognized the vehicle from the first time he dropped off alcohol to her.

The girl said Alcorn then drove them to his residence at a mobile home park in Sarver. She said the next thing she remembered was being dropped off at the Freeport home after a quick car ride.

The girl testified she “felt mutilated” when returning to the Freeport home after the incident. She testified she was on her period at the time, but there was more blood and pain than what she typically experienced.

The girl testified she did not remember if she ever entered Alcorn’s home or what she told her friends about the incident afterward.

She said a friend’s father took her to the hospital the next day, where a rape kit was collected.

Buffalo Township Lt. Sean Furlong testified the rape kit showed force was used, and foreign DNA taken from the girl’s underwear matched Alcorn’s.

Furlong also testified he took the girl’s verbal statement at the police station four days after the alleged assault. He said she was very nervous, but what she told him was consistent between instances when they spoke.

Alcorn is charged with one felony count each of rape, rape of an unconscious victim, rape of a substantially impaired person, sexual assault, statutory sexual assault, corruption of minors and criminal solicitation. District Judge Jack Ripper held all charges for court.

Alcorn’s formal arraignment is scheduled for 1 p.m. Jan. 6 in Butler County Common Pleas Court.
