Mortgage foreclosure writ issued against Vagabonds center
A writ of execution has been issued to serve the General Richard Butler Vagabonds Junior Drum and Bugle Corps in Butler Township with two mortgage default judgments.
After entering default judgments totaling $85,180 against the Vagabonds center on behalf of NexTier Bank in June, the county prothonotary’s office last week issued a writ of execution for the sheriff’s office to serve the center with the default judgments, which has reached $96,403 due to accumulating interest.
No one from the Vagabonds center responded to the mortgage foreclosure complaints NexTier filed in April, and the judgment has not been challenged in court.
Sheriff Mike Slupe said the writ will be served, and the center will be placed on the sheriff sale list in November.
The complaints say the nonprofit Vagabonds borrowed $105,000 in September 2017 and $50,000 in August 2021, and used its facility at 138 Whitestown Road as security for payment of the notes.
As of mid-March, the Vagabonds owed $49,323 on the $105,000 note and $35,857 on the $50,000 note, according to the complaints. Both of the amounts owed include interest and late charges accrued through March 13.
The $49,323 judgment assess $7.38 a day in interest beginning March 14 and has now reached $55,574, and the $35,857 judgment assesses $4 a day in interest and has now reached $40,829.
