City police charge 1 after large crowd disturbance Thursday
A Butler man was charged in connection to an incident where 20 people gathered in a city street and caused a disturbance Thursday night, Feb. 1.
City police said Deryious D. McCurty, 25, of Lyndora, told a responding officer to leave the Miller Avenue scene and was held at taser point.
He was charged with felony aggravated assault, misdemeanor disorderly conduct and summary public drunkenness.
Police responded about 11:10 p.m. to reports of 20 people near the 400 block of Miller Avenue. Upon arrival, a man later identified as McCurty was seen actively arguing with a bystander, documents showed.
When asked what was going on, police said McCurty stated “nothing,” and started to approach the officer on scene.
It was discovered McCurty arrived on Miller Avenue with a group and caused a disturbance for “no legitimate reason,” according to the affidavit.
Police said McCurty then told the officer to “get back in your car and go,” to which the officer asked McCurty to calm down.
McCurty continued to approach the officer, getting close enough the officer pushed him away to create a safe distance, according to the affidavit.
Police said McCurty then got into a fighting stance, putting his arms up and clenching his fists.
The officer drew his taser and told McCurty to back up and place his hands on his head, to which McCurty complied, according to documents.
Police said McCurty was held at taser point until other officers arrived to assist.
During transport to the city police station, police said McCurty refused to identify himself and an odor of alcohol was detected on his person.
McCurty’s preliminary hearing has not yet been scheduled.
