Butler settles lawsuit with former deputy police chief

Butler City Council accepted a general release and settlement agreement Thursday, Aug. 24, between the city and David O. Adam, a former deputy chief with the Butler Bureau of Police.

Adam’s complaint, filed in Common Pleas Court on April 3, 2019, states that he retired from his role in August 2018 and had unused holiday, vacation and sick time that he was not paid for after retiring. He also stated that he received incorrect payment for his sick time.

The complaint argued that Adam was entitled to $29,178 for his unused vacation, holiday and sick days and for his accumulated “comp time” — which is time off taken for working overtime hours in lieu of receiving overtime wages.

Mayor Bob Dandoy said Friday that the city’s insurance company paid the claim, but Butler had to pay a $12,500 deductible. He also said some details regarding the settlement are private because the lawsuit was a personnel legal matter. The amount paid by the city was not disclosed.

“When we get something like this, we hand it over to the insurance company,” Dandoy said.

Whippo Avenue park

Also on Thursday it was determined that Butler will no longer maintain a property on Whippo Avenue that was previously the site of a park.

Dandoy said the county owns the property and Butler maintains it, mainly by keeping the lawn mowed. He said the city and county have had a lease agreement for the property since the 1990s, but the agreement did not involve monetary payments.

Despite the end of the agreement, Dandoy said the city eventually could start a new project in the space.

“There are a number of small children in that neighborhood again,” Dandoy said. “This may be the beginning of a new project. We have to sit down and talk with the county to see what is possible.”
