Police still investigate fatal wreck

Shane Scott
ATVs banned on public road

EAU CLAIRE — A decision is likely weeks away on whether criminal charges will be filed in the death of a 20-year-old man Tuesday while riding an all-terrain vehicle in the borough, state police said Wednesday.

An accident reconstruction investigation and other evidence must be reviewed before police will turn over their findings to the Butler County District Attorney, said Sgt. Rachel Graham.

However, Graham indicated that the 14-year-old boy who was driving the ATV would face at the minimum summary traffic violations, including illegally riding the vehicle on a road.

State law excludes ATVs from use of public roads unless designated by the state or municipality.

Graham said there are no public roads in the county designated for ATV use.

The law does allow ATVs to cross over a public road to resume driving on a trail.

The law also specifies that an operator younger than 16 may drive an ATV to cross a public road only after having a safety certificate and under the supervision of someone at least 18 years old.

The boy, who police have not identified due to his age, lost control of the four-wheel Yamaha Blaster about 1:10 p.m. Tuesday on Garner Road at South Washington Street and collided with a tractor-trailer.

The teen and his passenger, Shane Scott, both of Eau Claire, were thrown from the ATV. Neither rider was wearing a helmet, police said. State law requires that operators and passengers on ATVs must wear helmets.

Scott was taken to Butler Memorial Hospital where he was pronounced dead at 2:42 p.m. of severe injuries.

An autopsy was conducted but the county coroner’s office provided no other information. A cause of death has not been released.

The boy suffered only minor cuts.

One of Scott’s brothers, Dave Scott Jr. of Petrolia, said Shane Scott was about to start at a new job the day after the accident.

“He was all excited about it,” Scott said.

He said his brother, who was an experienced ATV operator, was friends with the 14-year-old boy who was driving the ATV when the crash occurred.

“They were just having a little fun and an accident happened,” Scott said.

Shane Scott liked to camp and fish. He also liked to lift weights and casually play football and baseball with family and friends.

“He was very fit,” Scott said.

He had been dating Samantha Bevan of Grove City for about two years. They had one daughter, Peyton Scott, and Shane was helping to raise Bevan’s son, Caden, who Dave Scott said was his brother’s “little sidekick.”

Shane Scott attended Moniteau High School but did not graduate. His brother said he was taking classes to get his GED so he could improve his future for his family.

His obituary is on Page 6.
