Freeport man sentenced for corruption of minors
A Freeport man has been sentenced to 30 months of probation in a plea agreement in a 2014 case in which he was charged with sexually assaulting a 16-year-old girl in Adams Township.
Tod A. Gallagher, 53, pleaded guilty to misdemeanor charges of corruption of minors and disorderly conduct and was sentenced to serve 30 months of probation for the corruption of minors charge and a concurrent 12 months of probation for the disorderly conduct charge.
The sentence, ordered by Common Pleas Judge Timothy McCune last week, also requires Gallagher to complete the county's sex offender program and pay fines totaling $250.
The victim submitted a victim-impact statement, which was not read in court. Gallagher did not speak at the sentencing hearing.
The incident occurred in November 2014, but township police didn't file charges until January 2019.
Gallagher was released on $25,000 bond after charges were filed.
In an affidavit, police said an officer was dispatched Nov. 9 at 1:42 a.m. to a report of a 16-year-old girl who said she was kidnapped and that someone wants to kill her. County dispatchers determined the call came from an area on Mars Evans City Road, and police located her there.
She reported that she had been picked up by a 21-year-old she met through social media and Gallagher. During the evening, she said Gallagher gave her a large number of alcoholic drinks at Evans City Cemetery and a home on Mars Evans City Road, and made multiple sexual comments, according to the complaint.
She told police she drank throughout the evening and was quite intoxicated. She then said she remembers waking up along the side of a road with her pants and underwear down, and a male on top of her, according to the affidavit.
The victim said she punched the male in the head and ran away. Police noted that she had blood on her hands, but no wounds.
She was taken to a hospital where a sexual assault test was performed, and she was found with cuts and bruises on her hands, knees, ankles and upper back. A blood test revealed she had a blood alcohol content of .140%.
Police said a pair of smashed sunglasses, an auxiliary audio cable and blood were found at the scene along one side of Mars Evans City Road, and the victim's purse and more blood were found along the other side of the road, police said.
Gallagher later claimed ownership of the cable and the sunglasses. The blood found near the purse was a genetic match for Gallagher, according to the affidavit.
In addition, police said they talked to a witness who was in Gallagher's vehicle with him and the victim. The witness got out of the vehicle about a half-mile from where the victim was found, and the vehicle traveled south on Mars Evans City Road toward the area where the assault occurred, according to the affidavit.
The witness also told police the victim was highly intoxicated and vomited multiple times.
Police said a finger on Gallagher's hand was crushed and had a large cut, there was a fresh cut on his face, and there was blood on the driver's seat and windshield of his vehicle.
Gallagher initially was charged with rape of an unconscious victim, rape, attempted rape, attempted rape of an unconscious victim, disorderly conduct, two counts of corruption of a minor and five counts of indecent assault.
The charge of rape of an unconscious victim later was changed to attempted rape of an unconscious victim, and the rape charge was changed to attempted rape.
