Butler man sentenced to 30 months' probation
A Butler man was sentenced Thursday to 30 months of county probation after police found three pounds of marijuana in his trailer.
In March, police responding to a domestic dispute between Colton J. Augustine and Ruth S. Guterry of West Sunbury, both 24, found an array of marijuana in various forms, from consumable products to wax concentrations along with more traditional joints.
Amid all the marijuana products there was a 1-year-old — the daughter of one of the defendants, at the McCalip Farm Lane home in Jefferson Township, where the couple was living, police said.
After entering a plea agreement with the state, Augustine pleaded guilty to one felony charge related to the drugs and all the other charges against him were dismissed. Augustine must also pay a $750 fine.
The District Attorney’s office dropped charges against Guttery on Aug. 30 during the course of negotiations between the DA and her lawyer, Marco Attisano.
The two originally faced felony charges of possession with intent to deliver a controlled substance and child endangerment. They also were arraigned on misdemeanor charges of possession of a controlled substance and drug paraphernalia, and possession of a small amount of marijuana.
When police arrived at the trailer, they noticed what appeared to be marijuana and related contraband.
Police said Guterry handed over two glass containers with suspected marijuana inside. She told the troopers that Augustine, who had left the home, makes and sells concentrated THC products called “dabs,” according to a police affidavit.
When Augustine returned, he acknowledged that the marijuana was his and the two were arrested.
The items recovered, according to an inventory of seized property returned with the warrant, included Ziploc bags and jars with processed marijuana, two jars of edible marijuana and a container with 78 marijuana cigarettes.
Additionally, documents said, troopers found a box filled with a dozen glass containers of THC wax, additional containers with THC wax, cannabis oil, a digital scale, bongs, smoking pipes and marijuana grinders.
