Butler man sentenced to prison in assault, firearms cases
A Butler man was sentenced Thursday, Sept. 28, to serve time in the Butler County Prison after he pleaded guilty to assaulting a man on Main Street and, in a separate incident, firing a gun into the air during an argument.
Isaiah Louis Devaughn, 27, was sentenced to serve 6 to 12 months in jail after pleading guilty to a felony charge of aggravated assault filed by Butler City police.
Butler County Common Pleas Court Judge Timothy McCune ordered Devaughn be paroled to serve 24 months of probation, including six months of house arrest, after he serves six months in the county jail.
McCune also ordered Devaughn to pay $40,120 in restitution to the victim, Joseph Raab, who underwent surgery for a broken jaw sustained in the assault outside the Brick House restaurant on Main Street on Nov. 25, 2021.
Raab told police that he and a group of friends were outside the restaurant at closing time when he was punched in the face from behind. He said he was chased and ended up on the ground when a group of men began to assault him, according to an affidavit. Raab said a friend stepped in, but he also was assaulted.
Raab’s jaw was broken in seven places and required immediate surgery. He told police he would have suffered more injuries to his face had he not protected his head while he was on the ground.
Police said in the affidavit that surveillance video showed Raab was assaulted from behind by one man and then struck in the face by another man while he was backing away from the first man. Police said the camera captured the initial events of the assault.
Raab identified Isaiah Devaughn and Antonio Djour Devaughn, 24, of Butler through photos.
Police said the two admitted to the assault after showing them the video. Antonio Devaughn pleaded guilty to simple assault in June and was sentenced to 30 days of confinement followed by 18 months of probation.
In the second case, Isaiah Devaughn pleaded guilty to a charge of recklessly endangering another person filed by city police following a June 25, 2021, incident.
Police said he fired a gun in the air to break up an argument among six people, including some juveniles, on Liberty Street.
In that case, he was sentenced to serve 30 days to 12 months in prison and complete 50 hours of community service. That sentence will be served consecutively with the first.
