Dog dies in attack; shot fired in city

Butler City police have completed its investigation into a fight between dogs that resulted in one dog’s death and included a bystander who fired a gun in attempt to stop it.

Police issued a news release Wednesday about the July 5 incident.

Police said an unleashed dog owned by James Fleeger attacked a leashed dog owned by Melissa Ofchinick around 4 p.m. as Ofchinick walked hers at the intersection of North McKean and East Pearl streets. Police said the attack was unprovoked.

“The dog that was being walked on the leash (owned by Ofchinick) died as a result of the attack,” police said.

Fleeger was charged with summary offenses of harboring a dangerous dog, failure to confine the dog, and various license and certification offenses.

According to Butler City’s ordinances, it is an owner’s responsibility to have control of his dog at all times, especially in a public setting.

“No owner of any dog shall allow or permit such dog, whether licensed or not, to run at large within the City, either upon the streets or public grounds or upon private property of other than the owner of such dog,” the ordinance states.

It is also a requirement for each dog to be licensed to its owner. Ofchinick was charged with summary offenses for failure to license her dog.

Police said a third person, Daniel Potts, witnessed the fight and tried to break it up by firing a gun. According to police, no one was injured.

Potts was charged with an ordinance violation for shooting a gun in the city.

Butler City’s ordinance reads that anyone firing any gun, pistol or other firearm is committing disorderly conduct. The violation is punishable by a fine between $50 and $100 and possibly 30 days in jail.

Police said they worked with the State Bureau of Dog Law Enforcement throughout the investigation.
