Technicality erases parole in convict's drug case

Pgh. man is back behind bars despite early release

A Pittsburgh man's early parole from county jail was revoked Monday on a technicality and he was reincarcerated to serve his minimum sentence.

In March 2019, Shakor Wilder was sentenced to 21 months to four-and-a-half years in jail for two drug cases in Butler County. Wilder was released from jail in September, according to jail records, for early parole after receiving earned time for good behavior.

But Wilder's freedom was short-lived after prosecutors pointed out an oversight regarding state law that made Wilder ineligible for the early parole program because of an issue during his jail sentencing last March.

“In Pennsylvania, you must serve the minimum time. But Butler has earned time, so if you behave yourself, you could be paroled early — if that's put on the record at the time of sentencing.” said Jeffrey Weinberg, an attorney Wilder hired after his sentencing. Weinberg called the issue “highly technical” and explained that Wilder's previous lawyer failed to request early parole at the time of his sentencing.

Public defender Kimberly Hudak, who represented Wilder at the time, filed a request for early parole after his sentencing. The motion was granted, leading to Wilder's release in September. But that decision was reversed and, on Monday, the day of Wilder's birthday, he was taken back to jail after a commitment hearing.

“I feel bad for the kid,” Weinberg said. “As a defense lawyer, you think, 'Good news, my defendant is getting out,' only to find out, 'No, he has to go back in.' ”

Wilder was arrested and jailed after police stopped a vehicle in which Wilder was a passenger on March 24, 2018. The stop was made while police were surveilling a possible drug house in the 300 block of Third Street. Seized during the search were five large bags and one small bag of crack, documents said. In all, the crack weighed 47 grams.

Also allegedly found in the Jeep were three small containers with marijuana residue.

While out on bond, Wilder was arrested in August 2018 during a raid at an apartment on the 300 block of South Main Street by Butler County Drug Task Force officers.

During the raid, police found suspected crack cocaine, several hundred dollars, more than a half- dozen cellphones and other suspected drug contraband, authorities said.
