SUMMIT TWP — A suspected drugged driver was arrested after state police said he apparently passed out behind the wheel of a still running vehicle at a busy intersection.

James E. Walborn, 39, of Oakland Township is charged with driving under the influence of a controlled substance, possession of drug paraphernalia and careless driving stemming from the incident shortly before 7 a.m. Friday.

He is free on $3,000 bail while awaiting a hearing next week.

Police Cpl. Tim Morando was nearby and answered the call for an unresponsive man in the driver's seat of a Jeep stopped in one of the turning lanes at the intersection of Routes 38, 68 and 422 in Summit Township, police said.

The vehicle's engine was running as an East Butler Ambulance medic allegedly banged on the window to awaken the driver, later identified as Walborn.

After several window knocks, the defendant came to, police said, and the Jeep began to move.

“Put the vehicle in park,” the medic yelled to Walborn, according to Morando's affidavit. The medic opened the driver's door and put the Jeep in park.

Morando alleged that the defendant “started to yell and appeared to be confused.” He also did not seem to be aware of what happened.

On the passenger seat, police said they found a crack pipe that was inside a partially opened cigarette case.

A certified drug recognition expert later evaluated Walborn. Afterward, he allegedly refused to submit to a blood test.

His preliminary hearing is scheduled for Tuesday at the office of District Judge Lewis Stoughton in Chicora. He did not immediately return a telephone call Tuesday.

Police noted this was Walborn's second DUI in the past five years.
