A suspected drunken driver was more than two-and-a-half-times the state's legal limit for alcohol when Butler police say they found him passed out in a car with a loaded pistol tucked in his pants.

Dylan J. Graves, 22, of Renfrew was charged Monday in connection with the incident last month at the Shell gas station on West Jefferson Street.

Police said they were called to the store about 4:40 p.m. April 24 for an unconscious man sitting in the driver's seat of a car. Officers had to awaken Graves.

The defendant appeared to be intoxicated and he had trouble keeping his balance after getting out of the vehicle, according to charging documents.

He admitted he had a handgun in the front waistband of his pants. Police seized the .40-caliber pistol, which was loaded.

The defendant after failing field sobriety tests told officers that he had smoked marijuana before driving, documents said.

A search of his car turned up another loaded firearm, a .380-caliber pistol, which was in the center console. Police said they also found a half empty bottle of malt liquor.

Graves was taken to Butler Memorial Hospital for a blood test, which confirmed he had marijuana in his system and his blood-alcohol level was 0.222 percent. In Pennsylvania, a level of 0.08 percent is considered intoxicated.

He is charged with driving under the influence, possessing a firearm without a carry license and driving with an open container of alcohol.
