Developer files appeal of denial by supervisors
MIDDLESEX TWP — Officials at Wednesday's board meeting announced that the developers for the Grey Hawk Planned Residential Development have appealed the supervisors' decision to deny the plan.
The development featured 108 residential units on Overbrook Road and faced heated opposition from residents, with many voicing their opposition to the plan at public hearings and meetings.
Supervisors cited a potential threat to Glade Run Lake and the developers' decision not to present an alternative plan to the planning commission in their decision to deny tentative approval to the Grey Hawk PRD in March.
Township solicitor Mike Hnath said Wednesday that the case will now go before a judge who will schedule a hearing. The timeline has yet to be determined.
“It's up to the judge's schedule,” Hnath said.
He said the judge will likely base his decision on the public hearing transcripts and other evidence.
Asked what happens if the judge rules in favor of the Grey Hawk developers, Hnath said the township would have the right to appeal, though it may not have a strong case, depending on the judge's decision and reasoning.
“You always have a right to file an appeal,” Hnath said.
No further details were immediately available.
Also Wednesday, Middlesex Township K9 officer Mark Heider briefed officials and residents about the health of his partner, K9 Mibo, and what he's been up to over the past year.
In 2018, Mibo logged about 500 hours of work for the department.
“Most of the uses were business checks,” Heider said. “Some of the more newsworthy ones were bomb threats ... at the Mars School.”
Mibo is 6 years old and is in good health, Heider said. He receives free medical care from an area veterinarian.
Heider demonstrated Mibo's bag-sniffing abilities with a backpack lineup. Mibo quickly sniffed out the right bag.
Mibo is set to receive a custom protective vest ordered last year.
Heider said the vest has been on order and the department is waiting for the supplier to deliver it.
