A Clinton Township mother is accused of being more than double the legal limit for alcohol and on prescription medication while driving with two small children in her car last month in Butler.

Kylee L. Eshenbaugh, 23, faces a hearing in November on misdemeanor charges of driving under the influence of a combination of alcohol and drugs, and child endangerment.

Butler police filed the case Oct. 4 at the office of District Judge William Fullerton.

Police said they found the defendant along with a pair of children, ages 2½ years and 3 months, about 6 p.m. Sept. 4 in a car with two flat tires and driver's side damage on the 500 block of South Washington Street.

The children were in the back seat and crying. The older child, according to court documents, who was identified as Eshenbaugh's son, was “moaning,” and he had a feeding tube hanging off the back of the front seat.

The toddler, a police affidavit said, “has a significant medical history.”

Patrolman Cheryl Litz spoke to Eshenbaugh, who appeared confused and impaired.

The defendant told the officer that she “brought her children down to see their homeless father,” the affidavit said, and her tires went flat.

Investigators noted the car had driven over the corner of a sidewalk and struck a metal drain. No injuries were reported but the car had to be towed.

Police notified the Butler County Children and Youth Services agency to assist with the children, who, according to a police report, were “neat, clean and appeared healthy.”

While helping Eshenbaugh gather up the children's belongings, officers found an empty beer can underneath the front passenger seat. She was subsequently arrested for suspected drunken driving and taken to Butler Memorial Hospital for a blood test.

Toxicology results showed her blood-alcohol level was 0.202 percent, documents said. A level of 0.08 percent is considered intoxicated under state law.

The defendant also had the drug clonazepam in her system, police said. The medication is commonly used to treat anxiety and certain seizure disorders.

Police Deputy Chief David Adam said Eshenbaugh's children were eventually turned over to a relative's custody. Her preliminary hearing is set for Nov. 27.
